Terms of Service

1. Services & Subscriptions

Click Boost Web LLC provides custom PHP web development, maintenance, and hosting. Our primary model includes:

• Free Website Build: A custom-coded PHP site built within 48-72 hours at no charge.
• Maintenance Plan: Ongoing service at $150/month (USD) via Stripe, billed from your first payment date.
• Referral Reward: Refer a business to Click Boost and receive one free month of your care plan when they sign up. Credits are applied automatically with no cap on referrals.

2. Free Website Conditions

To prevent abuse of our "build first" model:

• We reserve the right to refuse any project at our sole discretion.
• The free build is a "design-only" phase; full ownership of the site files is only granted after the first successful monthly payment or payment of a transfer fee.
• If you choose not to subscribe, the website will be taken offline. You may request the source files for a one-time transfer fee of $500.

3. Billing & Payments

Payments are handled by Stripe. By providing payment details, you authorise recurring monthly charges of $150 USD starting immediately from your subscription date.

• Charges occur on a 30-day cycle starting from your first successful payment.
• All payments are processed in USD. Stripe handles currency conversion for international clients.
• Failed Payments: If a charge fails, we provide a 5-day grace period. After 7 days of non-payment, we reserve the right to suspend your website and hosting services.
• Referral Credits: Free months earned through referrals are applied as Stripe credits and reduce your next invoice automatically.

4. Intellectual Property & Ownership

You retain ownership of all content, logos, and data you provide. Upon the first successful monthly payment:

• You are granted a license to use the website design and custom code for your business.
• Click Boost Web LLC retains ownership of any pre-existing proprietary code, PHP scripts, or developer tools used to power the site.
• We reserve the right to display the work in our portfolio for marketing purposes.

5. Cancellation

You may cancel at any time. Cancellation takes effect at the end of the current paid billing cycle. No partial refunds are provided. Upon cancellation, the client has the option to pay a $500 transfer fee to receive a full export of the website files for use on third-party hosting.

You agree to indemnify and hold Click Boost Web LLC harmless from any claims, damages, or legal fees arising from the content provided by you for the website, including but not limited to copyright infringement or defamatory material.

8. Limitation of Liability

To the maximum extent permitted by law, Click Boost Web LLC's liability for any claim shall not exceed the total amount paid by the client in the three (3) months preceding the claim. We are not liable for lost profits, data loss, or business interruptions.

9. Governing Law & Dispute Resolution

These terms are governed by the laws of the State of Wyoming, USA. Any disputes arising from these terms shall be resolved through binding arbitration in Wyoming, rather than in court, to the extent permitted by law.
